IP8™ Terms and Conditions of use
Effective Date: 14-July-2025
Please read these Terms and Conditions (“Terms”) carefully before using the IP8 platform (“Service” or “IP8”), operated by IP8 LLC, a Wyoming limited liability company (“Company”, “we”, “us”, or “our”).
By registering for or using IP8, you (“User”, “you”, or “your”) agree to be bound by these Terms, which form a legally binding agreement between you and IP8 LLC. If you do not agree with these Terms, you may not access or use the Service.
1. Eligibility
You must be at least 18 years old and legally capable of entering into contracts to use IP8. By creating an account, you confirm that you meet these requirements.
2. Description of Service
IP8 is a software-as-a-service (SaaS) platform that uses AI to help users identify potentially infringing products by mapping patent claims to publicly available product information. The service in its current form includes:
- Infringement discovery and claim mapping
- Evidence of Use (EoU) report generation
- Continuous product monitoring and alerts
The service may be expanded to include newer functionalities in the future.
3. Account Registration
To access the Service, you must register and create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the confidentiality of your login credentials
- Be responsible for all activities under your account
Only one Free Plan organization is allowed per registered user. You may belong to or be invited to multiple organizations.
4. License and Usage Rights
IP8 grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your internal business or research purposes, subject to these Terms.
You may not:
- Reverse-engineer, decompile, or disassemble our software.
- Systematically scrape or compile data from IP8 into third-party databases or directories.
- Harvest user information (emails, usernames) or create accounts under false pretenses.
- Use the Service to develop a competing product
- Circumvent or disable security features or rate limits.
- Frame or link to the Site in an unauthorized way.
- Impersonate others or use bots/scripts to automate interactions.
- Upload malware or disruptive content (spam, excessive caps, “spyware”).
- Harass, threaten, or harm any IP8 personnel or other users.
- Use IP8 to compete with us or for any commercial resale.
- Remove any copyright or proprietary notices.
- Violate any applicable laws or regulations in your use of the Site.
5. Intellectual Property Rights
Unless otherwise indicated, the Site and Service are proprietary to IP8 LLC. All source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics (“Content”), and all trademarks, service marks, and logos (“Marks”) are owned or licensed by us and protected by U.S. and international intellectual property laws.
The Content and Marks are provided “AS IS” for your personal, non-commercial use. Except as expressly permitted, you may not copy, reproduce, republish, upload, post, transmit, distribute, sell, license, or otherwise exploit any Content or Marks without our prior written permission.
You retain ownership of any data, patents, documents, or custom content you provide or upload to the platform.
6. Guidelines for Reviews
Where IP8 allows you to post reviews or ratings, you must:
- Have direct experience with the entity reviewed.
- Avoid profanity, hate speech, or discriminatory language.
- Be unaffiliated with competitors
We may accept, reject, or remove any review in our sole discretion. Reviews are not endorsed by IP8 and do not necessarily reflect our views. By posting, you grant IP8 a perpetual, worldwide, royalty-free license to use, modify, and distribute your review content.
7. Third-Party Websites and Content
IP8 may link to third-party sites or display third-party content. We do not vet or endorse those sites or content and bear no responsibility for their accuracy, practices, or policies. If you leave our Site, these Terms no longer apply; please review the third party’s own terms and privacy policy.
8. Plans and Billing
IP8 offers the following plans:
- Free Plan: Limited monthly credits, auto-renewed
- Prepaid Pay-as-you-go Plan: Credits purchased in advance, deducted based on usage
- Enterprise Plan: Annual commitment with monthly credits and discounted overage rates
By selecting a paid plan, you agree to pay all applicable fees, and to the associated billing terms (monthly, quarterly, or annually). You must ensure your billing and payment details are accurate and up to date.
9. Use of AI and Data Privacy
IP8 uses both internally hosted custom AI models and enterprise-grade external AI models (e.g., Microsoft Azure OpenAI, AWS Bedrock). We do not send user data directly to third-party AI model providers such as OpenAI or Anthropic.
All AI processing:
- Is conducted via private cloud infrastructure
- Ensures your data is encrypted, isolated, and never used for model training
- Complies with enterprise security and data handling standards
10. Confidentiality
We treat all user-uploaded data (including unpublished patents and proprietary product materials) as confidential. User-uploaded data is encrypted in transit and at rest on IP8 servers. IP8 will not access or disclose your data except:
- As needed to provide the Service
- With your explicit permission
- To comply with legal obligations
You are responsible for ensuring that you have the right to upload any third-party materials.
11. Service Availability and Modifications
IP8 is provided “as is” and “as available.” We may update, suspend, or discontinue the Site or any feature at any time, provided that we:
- Give at least 30 days’ notice of any material changes or discontinuations affecting paid plans;
- Strive to minimize downtime and schedule maintenance during offpeak hours; and
- Honor any Service Level commitments applicable to your plan (e.g., uptime guarantees, support response times).
For unpaid (Free) users, we will use reasonable efforts to provide advance notice of significant disruptions. Except as set forth above, IP8 LLC will not be liable for any modification, suspension, or discontinuance of the Site.
12. Termination
We may suspend or terminate your access to the Service if:
- You violate these Terms
- You fail to pay for applicable usage under your selected plan
- You misuse the platform in a manner that disrupts others or harms our systems
You may cancel your account at any time. Prepaid credits are non-refundable and may expire after 12 months of inactivity.
13. No Legal Advice
The outputs generated by IP8 (including Evidence of Use reports) are not legal advice. IP8 does not establish an attorney-client relationship and should not be relied upon as a substitute for professional legal counsel.
14. Site Management
We reserve the right to:
- Monitor for and remove content that violates these Terms.
- Take legal action against violators, including reporting to authorities.
- Refuse or restrict access, or disable any user contributions that burden our systems.
- Manage the Site to protect our rights and ensure proper functionality.
15. Privacy Policy
Your use of IP8 is subject to our Privacy Policy: https://ip8.ai/privacy-policy/
By using the Site, you agree to be bound by our Privacy Policy, which is incorporated into these Terms and Conditions.
16. Disclaimer
THE SITE AND SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, IP8 LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE ARE NOT RESPONSIBLE FOR ANY ERRORS, INTERRUPTIONS, OR THIRD-PARTY CONTENT. USE AT YOUR OWN RISK.
17. Limitations of Liability
IN NO EVENT SHALL IP8 LLC OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY IS LIMITED TO THE FEES PAID BY YOU IN THE PRIOR 12 MONTHS.
18. Indemnification
You agree to indemnify and hold harmless IP8 LLC, its affiliates, and its team from any claims, damages, losses, or expenses arising from:
- Your misuse of the Service
- Your violation of these Terms
- Any third-party claims related to content you submit
19. Electronic Communications, Transactions, and Signatures
By using IP8, you consent to electronic communications and agree that electronic records, signatures, and notices satisfy any legal requirements for written communications.
20. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes will be resolved in the courts of Cheyenne, Wyoming.
21. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or through the platform. Continued use of IP8 after such updates constitutes your agreement to the revised Terms.
